Ethan’sToySet Terms of Service

1. Overview

These Terms of Service govern your use of ethanstoyset.com and purchases from Ethan’sToySet (“we,” “us,” or “our”). Ethan’sToySet is operated by Paul Gonzalez P, based in Yonkers, New York, United States.

Our store is hosted on Shopify, which provides our ecommerce platform. Ethan’sToySet is the seller responsible for your purchase and customer support.

Please read these Terms, our Privacy Policy, and our Refund & Return Policy before placing an order. By placing an order, you agree to these Terms to the extent permitted by law. Nothing in these Terms takes away mandatory consumer rights.

2. Eligibility and Lawful Use

You must be of legal age to enter a binding purchase agreement in your location, or have a parent or legal guardian place the order. Our store is intended for adults shopping for children.

You may not use the site for unlawful activity, fraudulent transactions, impersonation, harassment, infringement of others’ rights, distribution of malicious software, or unauthorized access to our systems. You must not interfere with checkout, bypass security measures, or collect other customers’ personal information without authorization.

We may restrict access where reasonably necessary to prevent fraud, abuse, security threats, or unlawful conduct. Such restrictions do not cancel our obligations concerning payments received or existing customer rights.

3. Product Information and Safe Use

We aim to provide accurate descriptions, prices, images, and availability. Colors may appear differently on different screens. A display difference does not excuse a materially inaccurate product description.

Review each product’s age guidance, warnings, dimensions, contents, and instructions before purchasing or using it. Follow the manufacturer’s safety instructions and provide adult supervision where appropriate. Do not give a child a product that is unsuitable for their age, damaged, or missing essential parts. Contact us if you have a safety concern.

Statements about play or learning describe intended uses and do not guarantee a particular developmental result. These statements do not limit our responsibility for product safety, accurate descriptions, or applicable warranties.

4. Prices, Payment, and Availability

The currency, product price, applicable taxes, and shipping charges will be shown at checkout. Review the total before completing payment. You authorize the payment method you provide to be charged for the order.

Prices and promotions may change for future purchases. We will not increase the agreed price of an existing order without your agreement.

Products are subject to availability. We may apply reasonable quantity or destination limits, prevent suspected fraud, or decline an order we cannot lawfully fulfill. If we cancel an order after taking payment, we will notify you and promptly refund the amount paid for the canceled goods and any associated charges that are no longer due.

If we discover a material pricing or listing error affecting your order, we will contact you to explain it and offer an appropriate correction or cancellation and refund, subject to applicable law. We will not charge you an increased price without your permission.

5. Order and Account Information

Provide accurate contact, billing, and shipping details. Notify us promptly if you notice an error. Changes may not be possible after shipment.

If you create an account, protect your login information and notify us if you suspect unauthorized access. You are responsible for purchases you authorize, subject to applicable consumer and payment protections.

6. Shipping and Fulfillment

We primarily serve customers in the United States. International orders are accepted only for destinations supported at checkout.

We use third-party suppliers, including sellers on AliExpress, to fulfill orders. Orders may ship directly from a supplier, may originate outside the United States, and may arrive in separate packages. Ethan’sToySet remains your contact for order support, returns, and delivery problems.

Review the shipping estimates and charges disclosed before ordering. If we cannot ship within the promised period, we will notify you, provide an updated estimate, and offer cancellation and a prompt refund as required by law. Where your consent to a delay is required, we will obtain it or refund the order. For U.S. orders with no stated shipment period, applicable federal shipment rules apply, including the usual 30-day shipment standard.

Any applicable import charges and responsibility for paying them must be disclosed before purchase. Nothing in these Terms imposes an undisclosed additional charge or removes mandatory delivery rights.

If your package is delayed, lost, damaged, or marked delivered but missing, email ethanstoyset@support.com. We will help investigate and provide a resolution appropriate to the circumstances and applicable law. Carrier tracking is evidence of delivery, but a delivery scan alone does not automatically determine the outcome of a claim.

7. Cancellations, Returns, and Refunds

Our 30-day money-back guarantee allows you to request a change-of-mind return within 30 days after delivery. Items must be unused, undamaged, and in their original packaging with included parts and accessories.

For these voluntary returns, customers pay return postage. Original delivery charges are not refundable unless required by law. We do not charge a restocking fee. These conditions do not limit remedies for faulty, damaged, incorrect, or misdescribed goods, or other statutory rights.

To cancel or start a return, email ethanstoyset@support.com. We will cancel and fully refund an order that has not shipped. Once it has shipped, the return process applies, subject to any additional legal cancellation rights.

Approved refunds are issued to the original payment method within 10 business days, or sooner where required by law. The payment provider may need additional time to post the credit.

Our Refund & Return Policy explains the full process, including return instructions, faulty items, and international consumer rights. That policy governs return procedures; mandatory law takes precedence over any conflicting condition.

8. Reviews and Other Submissions

You may share honest opinions about our products and service, including negative reviews. We do not prohibit or penalize honest criticism.

When you submit a review or other content for public display on our store, you retain ownership and grant us a nonexclusive, royalty-free permission to host, display, and format that content for its intended purpose. This does not transfer ownership to us or authorize us to change your opinion. Private support messages are not treated as public testimonials without permission.

Only submit content you have the right to share. Do not include confidential information about others, unlawful threats, impersonation, malware, or infringing material. We may remove spam, unrelated content, unlawful material, or content that violates these standards, but not merely because a review is unfavorable.

Any reviews sourced from another seller must be identified accurately and must not be represented as purchases from Ethan’sToySet. These Terms do not grant us rights to copy reviews or photographs from another website.

9. Website Content and Intellectual Property

Our branding, original text, and other original site materials are protected by applicable intellectual property laws. Other materials belong to their respective owners.

You may use the site for personal shopping and share links to it. You may not commercially reproduce or exploit protected content without authorization, except where the law permits. Nothing here restricts lawful commentary, honest reviews, or other legally protected uses.

10. Third-Party Services and Links

The site may use payment processors, Shopify services, and other third-party tools, or link to external websites. Separate terms and privacy notices may govern those services. An external link does not necessarily mean we endorse its content.

We do not control independent websites. However, using a supplier or service provider does not relieve us of our legal responsibilities for goods you buy from Ethan’sToySet.

11. Privacy

Our Privacy Policy explains how we collect, use, and share personal information, including information used for order fulfillment and Meta/Facebook advertising. Please review it before submitting personal information.

12. Website Availability, Warranties, and Liability

We work to keep the site available, but access may occasionally be interrupted by maintenance, technical failures, or events outside our reasonable control. We do not promise uninterrupted or error-free website operation.

Nothing in these Terms excludes applicable product warranties, our express commitments, or rights and remedies that cannot lawfully be excluded. We do not exclude liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence where such exclusions are prohibited. Product safety and product liability obligations remain subject to applicable law.

Any limitation permitted by law must be interpreted consistently with your mandatory consumer rights. These Terms do not require you to indemnify us for our own misconduct or waive a legally available remedy.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New York and applicable U.S. federal law, except where mandatory consumer protections in your place of residence apply.

Please contact ethanstoyset@support.com about a dispute so we can try to resolve it. Contacting us is not a condition for exercising a legal right. These Terms do not impose mandatory arbitration, waive class-action rights, or prevent you from bringing a claim in a court available to you under applicable law.

14. Changes, Severability, and Existing Orders

We may update these Terms for future use and purchases by posting a revised version with an updated date. Material changes will be communicated where required by law. Changes will not retroactively reduce rights relating to an existing order without a valid legal basis and any required agreement.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion is not a waiver of it.

These Terms and the policies incorporated into them form the agreement for the matters they address. They do not exclude binding product descriptions, express promises made at purchase, or mandatory legal rights.
